Crypto TDS in India: 1%, Form 141, 26AS and refunds

Crypto TDS is a collection and credit mechanism, not the final tax calculation. Understand who may deduct, what amount it applies to, how the April 2026 form transition works, and how to reconcile the credit.

1% TDS is calculated on consideration, not profit

When the VDA TDS rule applies, the deduction is generally tied to the consideration paid or credited for the transfer. It is different from the final VDA income calculation, which considers the transfer income and the restricted deduction for cost of acquisition.

Check the threshold and the payer’s role

Official department guidance under the earlier framework describes a ₹50,000 annual threshold for a specified person and ₹10,000 for other payers, subject to the statutory definitions and conditions. Do not split transactions to avoid a threshold. For current transactions, verify the corresponding provision under the Income-tax Act, 2025 and the platform’s documented process.

Cash, in-kind and crypto-to-crypto transfers differ operationally

Where consideration is wholly or partly in kind, the law can require tax to be paid before the consideration is released. A crypto swap is therefore not automatically outside TDS merely because no rupees move. Centralized exchanges may operate an agreed mechanism, while direct counterparties may have their own responsibilities.

Form 141 applies to the new-Act period in relevant cases

The e-Filing portal distinguishes payments or credits through 31 March 2026 from those on or after 1 April 2026. For relevant individual or HUF deductions under section 393(1), the current portal uses Form 141, including Schedule D for VDA payments. Earlier-period obligations can remain connected to Form 26QE.

Use the actual date of payment or credit and the official portal workflow. Do not change a historical form solely because you are filing it after the new Act began.

Reconcile exchange records with official tax records

  • Match seller PAN and payer details where applicable.
  • Match transaction date, consideration and TDS amount.
  • Check the relevant Form 26AS, AIS or certificate evidence available to you.
  • Investigate missing or duplicated entries before filing.
  • Keep exchange statements even when the official credit appears correctly.

When can crypto TDS lead to a refund?

TDS is generally claimed as a credit in the applicable return. If total eligible credits exceed the final tax liability calculated for the complete return, the filed return may result in a refund, subject to processing and verification. A platform deduction alone does not guarantee a refund, and a credit that does not appear in official records may need correction by the deductor.

TDS checklist for each transfer

  • Identify payer, seller, residency and applicable threshold.
  • Record gross consideration separately from profit.
  • Document whether payment was cash, in kind or VDA-for-VDA.
  • Use the form and section that match the transaction date.
  • Reconcile credit before claiming it in the return.
  • Seek advice for non-residents, business arrangements or disputed credits.
